COVID-19 and sentencing updates.
Commonwealth v. Nash & Commonwealth v. Elibert: SJC considers when a stay of execution due to COVID-19 issues is appropriate. In the course of clarifying “the legal standards to be applied by trial judges, appellate court single justices, and appellate courts when considering stays” of execution of sentences, the SJC addressed certain issues related to the new factor announced in Christie v. Commonwealth, 484 Mass. 397, 401-402 (2020), i.e., the COVID-19 pandemic.
