Board of Appeal Hearings

Board of Appeal Hearings.

Also known as “The Board of Appeal” for short, this is an administrative body that is overseen by the Division of Insurance. It consists of a panel of 3 lawyers, typically one appointee from the Attorney General’s Office, one from the Division of Insurance, and one from the Registrar of Motor Vehicles.

An Appellee will appear before the Board after they have been issued a license suspension by the Registry of Motor Vehicles and have been denied relief after a hearing at the RMV.

Immediate Threat Suspensions.

When, after observing your operation of your motor vehicle on a given occasion, a police officer files a report that indicates their belief that continuing to allow you to drive will endanger the public, the Massachusetts Registry of Motor Vehicles will act IMMEDIATELY to indefinitely suspend or revoke your driver’s license or right to drive. The RMV reviews the report and makes a determination as to whether you are a public safety risk.

CDL Suspensions

Commercial Driver’s License (CDL) Suspensions.

Commercial Driver's Licenses are governed by federal regulations. Several tests are required to secure a CDL. As a result of strict oversight, it only takes a slip up or two to lose your CDL forever. You cannot secure a CDL if your license is revoked in any other jurisdiction.

Hardship Licenses.

A hardship license or “Cinderella” license, is technically not a license, but rather an adjustment to the hours you are allowed to operate your motor vehicle on the license you already possess and enable you to keep up with school, work, medical treatments or family obligations.  Hardship licenses are available for several different types of suspensions, including DUI suspensions.

Out-of-State Suspensions.

With out-of-state suspensions, the Registry of Motor Vehicles will receive notice via the National Driver Register that you have, or may have, committed an offense out of state that led to a suspension in another jurisdiction. Massachusetts is part of an interstate pact that will honor the suspension of another jurisdiction, even if your record in MA is clean.

Elderly Drivers.
